The Code Enforcement Board of Appeals is the body that hears appeals from aggrieved individuals who have been given notice of violation of the City’s Building Codes. These violations concern the manner of construction or materials used in the erection, remodeling, repair, or maintenance of a building or structure. The Board is also concerned with the life safety or fire prevention practies in a building or structure.
Applications for appeal may be made when it is claimed that:
- The true intent of the code, codes, or rules legally adopted thereunder have been incorrectly interpreted.
- The provisions of codes do not fully apply.
- An equally good or better form of construction or maintenance can be used.
The Board’s membership consists of seven members, each being a member of a profession associated with the topics brought before the board. The membership consists of:
- Two architects
- A real estate professional
- A builder
- An electrician
- An engineer
- A mechanical technician
- A licensed plumber
Members have an alternate that is of the same profession to serve in their place. Members serve three year terms or until their successor is appointed. In addition, the Fire Chief and the Director of Neighborhood Services serve as ex-officio non-voting members.
